Fresh twist in Arror and Kimwarer dams cases after it emerged that the court file in the case challenging the prosecution of Italian firm CMC Di Ravenna boss disappeared mysteriously.
This prompted the Milimani Court Judge Anthony Mrima presiding on the matter to advise the parties involved in the case to give the court more time to find the file which was significant for the ongoing trial.
The Director of Public Prosecutions (DPP) office and Ethics and Anti-Corruption Commission (EACC) learned that the file could not be found at the registry.
Justice Mrima gave a break in the case as efforts were underway to recover the lost file, however, the file was not traced at the registry during the break.
The judge was then forced to informed the parties involved to appear before the High court Deputy Registrar once the file is found.
Justice Mrima further noted that once the file is located, the involved parties will be given further directions on the case next hearing.
The Italian companies CMC Di Ravenna Cooperativa and CMC Di Ravanna- Itinera and Itinera S.P.A
believed were awarded the Arror and Kimwarer dams tender which turned scandalous have moved to the International Court of Arbitration to sue Kenya.
The Italian companies also cited the rift between President Uhuru Kenyatta and his Deputy President William Ruto as the main cause of the alleged cancellation of their tenders and the project too.
In the affidavits filed before the court, the three firms quoted that President Kenyatta canceled the tenders to block DP Ruto from running for the presidency in 2022.
“It seems hardly coincidental that the highest-ranking official to be investigated and charged in the criminal proceedings is Kenya’s (former) Treasury Cabinet Secretary, Mr. Henry Rotich, an ally of Mr. Ruto,” the Italian companies.
